The Government of Maharashtra has amended the Maharashtra Cooperative Societies Act, 1960 in 2013 and introduced new election procedure for cooperative housing societies.

Dear Sir, Please let me know if An Associate Member ,who has not contributed towardas the purchase of the flat , but has become an associate member after the member given him anNOC & paying only Rs. 100/- become a COMMITTEE MEMBER.

Associate member can be part of managing panel

MUMBAI: The state cooperative election authority (SCEA) has clarified that a housing society’s associate members can be part of the managing committee. This will be a shot in the arm for old cooperative housing societies as more residents can participate in their housing complex’s affairs.
As per New enactment in the CHS act as well as per amendment 97 no person can be accepted as an Associate member unless his name appears in agreement & also his name should appear in the share certificate .
I had a query pertaining to Associate member being deemed co-owner, kindly advise as to the rights of an associate member.

We are cop. registered in khar mumbai. we are society of 11 member only . do we have to follow the election procedure? or can we do our internal elections as we do each year

If any co-operative hsg society in Maharashtra , do not follow the procedure for elections as per law, then what the provision in law to take action against such societies ? what is the penalty/punishment? Can I get reference number of GR ?
Our society has more than 200 members. Our society recently conducted elections which are not as per this new rules. Where should I file the complaint regarding this ? It based out of Pune, Maharashtra.
Our C.H.S. has 32 flats .Three flat owners without election and voting process have declared themselves to the post of chairman secretary and treasure. all this owners have more than two children.what action can be taken against them.Please suggest.
Our society committee members appointed a person as a secretary of society who was not a committee member without elections n without informing tenants. This committee decisions can be exepted

What is the process if the Secretary resigns? Also if a MC member resigns? Can a MC function with less members than stipulated by the bye laws?
1. If Secretary resigns, the Authority viz SCEA-State Co-operation Election Authority has to be informed & election is conducted.
2. If one MC member resigns, the member can be co-opted by a simple majority provided that the co-oped member is willing to be considered for co-option.
Co-opted is not allowed as per bye-laws. Contact registrar office.
Sir we had our cooperative society election. I had filled my form. I was a member for the previous term. I was out of town that day of election and the representative refused to accept my form as I was not present . Is this as per the bye laws.
